Report of the Attorney General on Ordinance No, 8 of 1873.

This Ordinance has been passed, by direction of the Secretary c. 0. D. No. of State, for the purpose of making certain additions and amend- 189 of 21st De ments in Ordinance No. 12 of 1872 "to regulate the Manufac- cember, 1872. ture, Importation, Storage, aud Carriage of Explosive Substances." It is usually found more convenient in such cases to repeal the Ordinance and re-enact it with the amendments suggested, and

that course has in this instance been adopted.

It is proposed to adopt partially the title of one of the Im- (29 & 30 Vic., perial Acts from which many clauses are taken, and to call the f. 69.) new Ordinance "The Dangerous Goods Ordinance, 1873."

In the enumeration of Dangerous Goods in Section V, "Car- Fide C. O, D. tridges" have been left out, as it is considered that the use of sup. the word is misleading; for if loaded with Gun Cotton, Cartridges would be included under the Ordinance, and if loaded with Gun- powder they would fall within the provisions of Ordinance No. 4 of 1867.

The following substances are added to the list of Dangerous Goods: Dynamite, Lithofracteur, and Horsley's Patent Blasting Powder.

Section XI is amended by excepting Nitro-Glycerine among goods which may in certain small quantities be kept without a License, as in 29 & 30 Vic., c. 69, s. 8.

Section XIV is amended by inserting the words "not exceel- ing" before "Two thousand Dollars," and also before Two Years."

Section XIX provides for the prosecution of Offences against Section XIV before Two Magistrates either summarily or with power to commit for Trial at the Supreme Court. A similar pro- vision will be found in Section XV of the recent "Chinese Emi- grant Ship Fittings Ordinance," No. 3 of 1873.

Sections XVI, XVII and the last phrase of Section XV of the old Ordinance have been omitted in the new one, as their contents

are already provided for in Ordinance No. 10 of 1844.

Section XX of the new Ordinance is substituted for Section XVIII of the old one which would not be found to work well,

By Section VII, power is given to the Governor in Council to declare what other goods shall be deemed "Dangerous" within the meaning of the Ordinance.

Subject to the above amendments, and to a general revision and re-arrangement of the Clauses, the new Ordinance contains the same provisions as the one of 1872 which it repeals.
